RTCA Privacy Policy

This Privacy Policy applies to the websites [rtca.org and my.rtca.org] (the “Sites”), which are owned and operated by RTCA, Inc. (“RTCA”, “we”, “us”, or “our”).  RTCA has developed this Privacy Policy (this “Policy”) because we know you care about your personal privacy and about the terms and conditions that govern your use of these Sites.  This Policy describes the information that we collect when you use and access the Sites, how we (or our trusted third-party service providers) use it and how and under what circumstances we share that information.  This Policy does not apply to information collected in any other way, such as offline communications.

 

When you submit information to or through the Sites, you consent to the collection and processing of your information as described in this Policy.  By accessing the Sites, you are accepting all terms and conditions outlined below.

 

The Sites are not designed for or targeted at children under the age of 13. RTCA does not knowingly solicit or collect personally identifiable information from children under the age of 13 through the Sites.  If we discover that a child under the age of 13 has submitted personally identifiable information without verifiable parental consent, we will delete that information.

The Personal Information We Collect About You

RTCA collects personally identifiable information about you when you voluntarily supply information through the Sites that personally identifies you and/or allows us to contact you, including any and all materials submitted by you.

This applies when:

1. Fill out a membership application form

2. Create an individual profile to:

     a. Purchase products

     b. Sign up for training courses and/or events

     c. Make an online payment

 “Personally identifiable information” means information associated with or used to identify or contact you.

This information is collected and stored in the United States.  If you do not wish for your personal information to be stored in the United States, then you should not submit this information to us. If you choose to submit this personal information to us, you agree and consent that this information may be transmitted to and stored in the United States, subject to the terms of this privacy policy. 

  1. Cookie Policy

 When you use the Sites, we may automatically collect certain non-identifying information about you or “Usage Data”, such as your movement about the Sites, the type of browser or operating system you use, or the domain name of the website from which you linked to the Sites.  We use the information that we collect to operate, improve and personalize the Sites and to provide customer service. Our Sites also uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the Google analyze your Usage Data. You may refuse the use of cookies by selecting the appropriate settings on your browser as all major browsers allow you to block or delete cookies from your system.  In addition, these Sites may also utilize web beacons.  A “Web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies back to a web server. The information collected through this automated means may include information that we gather and store about your visit.  By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

2.Disclosing Your Information to Third Parties/Onward Transfer

Any information we gather, whether voluntarily provided by you or automatically collected, may be used for our internal business and marketing purposes but will not be sold, rented, shared or otherwise disclosed to third parties for any purposes, except as stated below.

We treat the information you submit through our Sites as confidential. We collect and process personal information for our legitimate interests consistent with applicable law, including to perform services requested by you.  We may share personally identifiable information about you with other trusted companies or people to perform functions for which we engage them, namely

  3. Constant Contact
  4. Authorized.Net

  We include contractual requirements for these entities that require them to use   your personally identifiable information only to the extent necessary to assist us and are required to protect the information. Additionally, we may share personally identifiable information (e.g., contact information) about you if you are your company’s representative through our members only directory with other members.

Notwithstanding any other statements or representations in this Policy or elsewhere on our Sites, we reserve the right to disclose any information in our possession if we are required to do so by law or we believe, in good faith, that such a disclosure is necessary to comply with the law, defend our rights or property, or to respond to an emergency. 

3. Security

 We implement reasonable physical, technical and administrative safeguards designed to maintain the safety of the personal information that you submit.  However, the security of information transmitted through the internet can never be guaranteed.  We (like all websites) cannot warrant or guarantee 100% security of any information you transmit to us on this Sites.

4. Data Retention

We will only retain your Personal Information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. In compliance with GDPR, you have the right to request to anonymize your data with your financial information retain as required by law. The financial information cannot be used to identify you as the constituent once your data have been anonymized.

 5. Third Party Links

 These Sites may contain links to websites maintained by third parties with whom we have no affiliation.  This Policy does not reflect the privacy practices of those sites, and you should consult the privacy policies of those sites to learn about their practices.  A link to any third-party site does not mean that we endorse it, or the quality or accuracy of information presented on it.

If you have questions or comments about this Policy or would like to review, update correct or delete any personally identifiable information you have provided, please contact us at info@rtca.org.  We will undertake reasonable efforts to investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the principles contained in this Policy.

7. Your rights in Connection with these sites

Under laws in certain countries in which we operate, individuals have a right to access Personal Information about themselves, and to amend, correct or delete Personal Information that is inaccurate, incomplete or outdated.  We will, on request, provide an Individual with confirmation regarding whether we are processing Personal Information about them, consistent with applicable law. In addition, upon request of an Individual, we may take reasonable steps to correct, amend, or delete their Personal Information that is found to be inaccurate, incomplete or processed in a manner non-compliant with this Policy or applicable law, except where the burden or expense of providing access would be disproportionate to the risks to that Individual’s privacy, where the rights of persons other than the Individual would be violated or where doing so is otherwise consistent with applicable law. Unless prohibited by applicable law, we reserve the right to charge a reasonable fee to cover costs for providing copies of Personal Information requested by Individuals.

Although we make good faith efforts to provide Individuals with access to their Personal Information, there may be circumstances in which we are unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If we determine that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information.

Where otherwise permitted by applicable law, you may send an e-mail to info@rtca.org or use any of the methods set out in this Policy to request access to, receive (port), seek rectification, or request erasure of Personal Information held about you by us.  Such requests will be processed in line with local laws.

8. RECOURSE, ENFORCEMENT AND LIABILITY

We encourage Individuals covered by this Policy to raise questions about the processing of Personal Information about them by contacting us through the contact information provided in this policy. Any Personnel that we determine is in violation of this Policy will be subject to disciplinary action up to and including termination of employment, where applicable.

If you are an EU or Swiss citizen and feel that we are not abiding by the terms of this Policy, please contact us at the contact information provided in this policy. If any request remains unresolved, you may contact the national data protection authority for your EU Member State.

9. Notices and Changes to our Policy

By using these Sites, you agree to the terms and conditions contained in this Privacy Statement.  We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel transactions. If you do not agree to any of these provisions, you should not use these Sites or any RTCA benefits, services, or products.

The Effective Date of this Policy is set forth at the top of this Policy. We reserve the right to modify this Policy at any time, for any reason, without notice to you, other than the posting of the amended Policy, and its effective date, on this page. For this reason, you should regularly review this Policy and note the effective date. Your continued use of the Site after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions.
